Responding to a New Virtual Mediation

You just received notice that a dispute has been filed against you. Here’s what you need to respond and get started.

Responding to a new Virtual Mediation using New Era is simple, but there are a few pieces of information you will need in the process.

  1. An email from New Era will arrive immediately after the claimant has filed the mediation, inviting you to respond.

  2. When you create an account and log into New Era, you'll see a message at the top of the home page. Click on the link to respond to your case.

  3. Enter your contact information as well as your attorney’s contact information (if applicable). You’ll be able to add additional members to your party after the case has been fully initiated.

  4. Click “Next” to continue to the Dispute Details step.

  5. At the top of the page, you’ll see the information that the claimant has entered about the case, including the damages claimed.

  6. Enter your “walk away” amount, or the amount of money you would be willing to pay to drop the claim (and any counter-claims). This is optional.

  7. Finally, enter any counter-claims you may have against the claimant, which may include monetary damages or non-monetary relief. This is optional.

  8. The checkbox to the right refers to the amounts that each party would either accept or pay to resolve the dispute. If both parties’ numbers are within 5% of each other, the neutral will be provided this information as a data point to facilitate a settlement more quickly. Check this box if you would like to provide this information.

  9. Click “Next” to continue to the Review & Fees step.

  10. Review your case details and enter your credit card information to be charged your portion of the mediation fees. Typically, the fees will be split 50/50 between claimant and respondent, unless otherwise agreed to by both parties.

  11. Once your payment is submitted, your case is officially initiated. The neutral selection will occur either through the Rank and Strike process or, if desired by both parties, through an assignment by New Era.
