During your virtual mediation, you will have the opportunity to share documents that contain relevant details about your dispute that you think would be helpful in advocating your side. Both parties will have until the day that is 10 days prior to the mediation date to submit this supporting documentation.

  1. You can upload your documents by clicking on “Documents” in the left menu of your case.

  2. In the “Supporting Documents and Exhibits” area, drag and drop or use your file picker to add documents that you feel are relevant to your case. These can include photos, contracts, emails or other communications, etc.

  3. The Supporting Documents and Exhibits will be visible to the mediator at all times during the virtual mediation process and will not be disclosed to the other party at any time, unless the virtual mediation fails and in post-mediation, both parties elect to pursue the binding decision process.

  4. The Mediation Statement is your opportunity to provide a narrative explanation of your arguments and side of the case directly with the mediator. This will never be shared with the other party. In the “Mediation Statement” area, drag and drop or use your file picker to add documents.

  5. For all documents,

    • Accepted file types include .pdf, .bmp, .jpeg, .png, .tiff, and .webp

    • There is a total size limit of 100MB in each section.

    • You can edit the description for each file by clicking on the pencil icon.

  6. All documents are saved automatically, but are not visible to the mediator until you submit them by clicking "Submit Documents" at the bottom of the page. You cannot remove documents, add any new ones, or edit existing ones (i.e. descriptions) once you have officially submitted.

  7. After submission, you’ll see a list including each document’s exhibit number and submission date and time.

  8. Documents uploaded to the New Era ADR platform will be retained for sixty (60) calendar days from the end of the case or the issuance of a decision/term sheet, whichever is later. You will be able to download documents for your case file up to this date, at which point all documents will be permanently deleted and inaccessible. New Era ADR does not maintain backup tapes or other redundant storage mechanisms post-deletion.
